第1條 風險條款 Risks Clause
第1條 風險條款 Risks Clause
1 This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in clause 4,5,6 and 7 below
本保險承保除了下述第4、5、6 和7 條規(guī)定的除外責任以外的保險標的的滅失或損害的一切風險。
第2條 共同海損條款(General Average Clause)
2 This insurance covers general average and salvage charges, adjusted or determined according to the contract of affreightment and /or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clause4,5,6 and 7 or elsewhere in this insurance.
本保險承保根據(jù)貨運合同及/或管轄的法律和慣例理算或確定的，為避免或與避免任何原因造成的有關(guān)引起共同海損和救助費用的損失，但第4，5，6和7條或本保險其他條文的除外條款除外。
第3條 “互有責任碰撞”條款(Both to Blame Collision Clause)
This insurance is extended to indemnify the Assured against such proportion of liability under the contract of affreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim.
本保險擴展賠償被保險人根據(jù)貨運合同中“互有責任碰撞”條款的比例責任有關(guān)可獲賠償?shù)膿p失。在船東根據(jù)該條款提出任何索賠的情況下，被保險人同意保險人，保險人有權(quán)自負費用，為被保險人對此種索賠抗辯。
第4條 一般除外條款(General Exclusions Clause)
4 In no case shall this insurance cover
在任何情況下本保險不承保
4.1 loss damage or expense attributable to wilful misconduct of the Assured.
可歸因于被保險人的故意不端行為造成的滅失、損害或費用
4.2ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matter insured
保險標的通常的滲漏、通常重量或體積損失或通常磨損。
4.3loss damage or expense caused by insufficiency or unsuitability of packing or preparation of the subject-matter insured (for the purpose of this Clause 4.3 “packing” shall be deemed to include stowage in a container or lift tray but only when such stowage is carried out prior to attachment of this insurance or by the Assured or their servants)
保險標的的包裝或準備不足或不當造成的滅失、損害或費用（在本款的意義上，“包裝”應(yīng)視為包括集裝箱或托盤內(nèi)的積載，但僅限于此種積載是在本保險責任開始之前進行或是由被保險人或其雇員進行這場合。）
4.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured
保險標的的固有缺陷或性質(zhì)造成的滅失、損害或費用。
4.5 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insured against (except expenses payable under Clause 2 above).
遲延直接造成的滅失、損害或費用，即便該遲延是由于某種承保風險造成的（但根據(jù)上述第2條支付的費用除外）。
4.6 loss damage or expense arising from insolvency or financial default of the owners managers charterers or operators of the vessel.
因船舶所有人、管理人、承租人或經(jīng)營人的無償付能力或財務(wù)困境引起的滅失、損害或費用。
4.7 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter
因使用原子或核裂變和/或聚變或其他類似反應(yīng)或放射性力量或物質(zhì)造成的任何戰(zhàn)爭武器產(chǎn)生的滅失、損害或費用。
第5條不適航和不適運除外條款 (Unseaworthines and Unfitness Exclusion Clause)
5.1 In no case shall this insurance cover loss damage or expense arising from
unseaworthness of vessel or craft, unfitness of vessel craft conveyance container or lifivan for the safe carriage of the subject-matter insured, where the Assured or their servants are privy to such unseaworthiness or unfitness, at the time the subject-matter insured is loaded therein.
本保險在任何情況下均不承保因下述原因所致的滅失、損害或費用： 船舶或駁船不適航，
船舶、駁船、運輸工具、集裝箱和托盤對安全運輸保險標的不適合，在保險標的被裝上船當時，被保險人或其雇員對此種不適航或不適合有私謀。
5.2 The Underwriters waive any breach of the implied warranties of seaworthiness of the ship and fitness of the ship to carry the subject-matter insured to destination, unless the Assured or their servants are privy to such unseaworthiness or unfitness.
保險人放棄運載保險標的至目的港的船舶不得違反船舶適航和適運的任何默示保證，除非被保險人或其雇員對此種不適航或不適運有私謀。
第6條 戰(zhàn)爭除外條款 (War Exclusion Clause)
6 In no case shall this insurance cover loss damage or expense caused by
6 本保險在任何情況下均不承保下述原因造成的滅失、損害或費用
6.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power
戰(zhàn)爭、內(nèi)戰(zhàn)、革命、叛亂、暴動，或由此引起的民間沖突(civil strife)，或來自交戰(zhàn)方或針對交戰(zhàn)方的任何敵對行為。
6.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or any attempt thereat
捕獲、扣押、扣留、拘留或羈押（海盜除外），及由此引起的后果或企圖這么做的任何威脅。
6.3 derelict mines torpedoes bombs or other derelict weapons of war.
丟棄的水雷、魚雷、炸彈或其他被遺棄的戰(zhàn)爭武器。
第7條 罷工除外條款(Strikes Exclusion Clause)
7 In no case shall this insurance cover loss damage or expense(
本保險在任何情況下均不承保下列滅失、損害或費用：
7.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions
由罷工、被迫停工工人或參加工潮、暴亂（riots）民事騷亂（civil commotions）的人員造成者
7.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions
罷工、停工、工潮、暴亂或民事騷亂引起者
7.3 caused by any terrorist or any person acting from a political motive.
恐怖分子或出于政治動機而作為的任何人員造成者。
第8條 運輸條款(Transit Clause)
8.1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either
8.1 本保險責任始于貨物運離保險單載明的倉庫或貯存處所開始運送之時，在運送的通常過程期間持續(xù)，終止于
8.1.1 on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein,
8.1.1 在載明的目的地交付到收貨人的或其他最后倉庫或貯存處所
8.1.2 on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either

8.1.2.1 for storage other than in the ordinary course of transit or
8.1.2.1 運送的通常過程以外的貯存或
8.1.2.2 for allocation or distribution. Or

8.1.3 on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge, whichever shall first occur.

8.2 if, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.
8.2 如果在最后卸貨港卸離來自海外的船舶后，但在本保險終止之前，貨物被轉(zhuǎn)運至非保險承保的其他目的地，本保險在依然受前述規(guī)定的終止制約的同時，截止于開始向此種其他目的地運送之時。
8.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause 9 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipment and during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment.
8.3 在被保險人不能控制的遲延任何繞航、強制卸貨、重裝或轉(zhuǎn)運期間，以及船東或承租人行使根據(jù)貨運合同賦予的自由權(quán)引起的海上冒險的任何變更期間，本保險仍然有效（但須受上述規(guī)定的終止和下述第9條規(guī)定的制約）。
第9條 運輸合同終止條款(Termination of Contract of Carriage Clause)
9 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either
9如果由于被保險人不能控制的情況，運輸合同在保險單載明的目的地以外的港口或地點終止，或運送在上述第8條規(guī)定的交付貨物前另行終止，那么本保險也終止，除非迅速地通知了保險人且在本保險仍有效時要求繼續(xù)承保，并受保險人要求的附加保險費的制約：
9.1 until the goods are sold and delivered at such port or place, or unless otherwise specially agreed, until the expiry of 60 days after arrival of the goods hereby insured at such port or place, whichever shall first occur, or
9.1 直至貨物在此種港口或地點出售并交付，或除非另有特別約定，直至承保貨物到達此種港口或地點滿60天，二者以先性生者為準，或
9.2 if the goods are forwarded within the said period of 60days (or any agreed extension thereof)to the destination named herein or to any other destination, until terminated in accordance with the provisions of Clause 8 above.

第10條 航程變更條款(Change of Voyage Clause)
10Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and on conditions to be arranged subject to prompt notice being given to the Underwriters.
10如果在本保險責任開始后，被保險人變更目的地，應(yīng)按重新商定的保險費率和條件續(xù)保(held covered)，但以迅速通知了保險人為前提。
第11條 保險利益條款(Insurable Interest Clause)
1111.1In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insured at the time of the loss.
11.1 為了根據(jù)本保險索賠，在保險標的損失當時被保險人必須具有某種可保利益。
11.2 Subject to 11.1 above, the Assured shall be entitled to recover for insured loss occurring during the period covered by this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unless the Assured were aware of the loss and the Underwriters were not.
11.2 根據(jù)上述11.1款，被保險人有權(quán)索賠在本保險承保期間發(fā)生的承保損失，盡管該滅失發(fā)生于本保險合同成立之前，除非被保險人已知悉該滅失，而保險人不知情。
第12條續(xù)運費用條款(Forwarding Charges Clause)
12 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a port or place other than that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.
This Clause 12, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clause 4,5,6 and 7 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants.
12 若由于本保險承保的風險的作用，導(dǎo)致承保的運輸在保險標的根據(jù)本保險承保的目的地以外的港口或地點終止，保險人將補償被保險人因卸下、貯存和續(xù)運保險標的至所承保的目的地而適當和合理發(fā)生的額外費用。
對共同海損和救助費用不適用的本條規(guī)定，須受上述第4、5、6和7條所包含的除外責任的制約，且不包括因被保險人或其雇員的過錯、疏忽、無償付能力或財務(wù)困境而引起的費用。
第13條 推定全損條款(Constructive Total Loss Clause)
13No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured is reasonably abandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination to which it is insured would exceed its value on arrival.
13 除非由于實際全損看來不可避免，或因為恢復(fù)、修復(fù)和續(xù)運保險標的至承保的目的地的費用，將超過其抵達時的價值，而合理地委付保險標的，推定全損索賠不能獲得賠償。
第14條 增值條款(Increased Value Clause)
14.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of the cargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Value insurance covering the loss, and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurance.
14.1 如果被保險人對保險貨物辦理了增值保險，貨物的約定價值應(yīng)視為增加至本保險和承保滅失的所有增值保險的保險金額的總和，本保險項下的責任應(yīng)按承保金額占此種保險金額的總和的比例計算。
倘若提出索賠，被保險人應(yīng)向保險人提供所有其他保險的保險金額的證據(jù)。
14.2 Where this insurance is on Increased Value the following clause shall apply:
The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primary insurance and all Increased Value insurance covering the loss and effected on the cargo by the Assured,and liability under this insurance shall be in such proportion as the sum insured herein bears to such total amount insured.
In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under all other insurance.
14.2 在本保險是增值保險的情況下，應(yīng)適用下述條款：貨物的約定價值應(yīng)視為等于由被保險人對貨物辦理的原始保險和承保滅失的所有增值保險的保險金額的總和，本保險項下的責任應(yīng)按承保金額占此種保險金額的總和的比例計算。
萬一提出索賠，被保險人應(yīng)向保險人提供所有其他保險的保險金額的證據(jù)。
第15條 不生效條款（Not to Inure Clause）
15This Insurance shall not inure to the benefit of the carrier or other bailee.
承運人或其他保管人不得主張本保險的利益。
第16條 被保險人的義務(wù)條款(Duty of the Assured Clause)
16It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder
16有關(guān)可索賠的損失，被保險人及其雇員和代理人有下述義務(wù)：
16.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss, and
16.1 采取為避免或盡量減少此種損失的全理措施，并
16.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercised
16.2 確保對承運人、保管人或其他第三方追償?shù)乃袡?quán)利被適當保留和行使。
第17條 棄權(quán)條款(Waiver Clause)
17 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party .
被保險人或保險人采取的旨在撈救、保護或恢復(fù)保險標的的措施不得視為放棄或接受委付或在其他方面損害任何一方的權(quán)利。
第18條 合理速辦(Reasonable Dispatch Clause)
18 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within their control.
被保險人應(yīng)在所有其控制的情況下合理迅速地行動是本保險的一項條件。
第19條 英國法律與慣例條款（English Law and Practice Clause）
19 This insurance is subject to English law and practice.
